If This wesbite is operated by JC Football PTY LTD. Throughout the site, the terms “we”, “us”, “our” refer to JC Football. JC Football offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”,”Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered and offer, acceptance is expressly limited to these Terms of Service.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibilty to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Delivery Information
JC Football will use best efforts to meet the indicated delivery time. The courier may require a signature upon receipt of delivery. If you are not home when the courier delivers your product, your product will be returned to the Depot. The courier will leave a note in your post box notifying you.
JC Football does not guarantee the availability of a product advertised; however, you will be notified if we are unable to supply you with the goods you have ordered. All prices on the website are in Australian dollars and include GST. All prices are subject to change.
JC Football reserves the right to charge freight costs to rural or remote areas of Australia above the website quoted fee.
Medical
If you know about or are concerned that that you may have a medical condition which might interfere with undertaking activity safely you should seek advice from a relevant medical professional and follow that advice.
You should not undertake activity that is beyond your own ability or you having been told are not suitable.
Be aware that sporting activity carries a risk of injury. Activity is completely voluntary; by participating you accept the risk normally associated with sporting activity.
In the event of illness or injury at a JC Football program (or associated event or program), you hereby grant JC Football staff and/or representatives full consent to administer medical treatment and/or take appropriate action to call on appropriate medical professionals (including ambulances if required) at your own cost.
Activity
Appropriate attire must be worn for the duration of the program. This includes, but not limited to:
Football boots (no metal studs), Shinpads JC Football attire (provided), Mouthguard (if applicable), Headgear (if applicable)
Photography and Videography
JC Football and its sponsors may take photographs and videos of players and distribute these on social channels, marking campaigns and promotional materials.
If you or your child do not want to be photographed we require this in writing. Please email us at info@jcfootball.com.au before the commencement of each individual booking to ensure this will be actioned. We still cannot guarantee this participant will not be featured in marketing material, but we will do our best to ensure they aren’t.
Invoices
JC Football will invoice the Client before the commencement of the program, unless otherwise notified by the Client regarding payment schedules. The Client agrees to pay invoice(s) by the due date(s) specified. Unpaid or overdue invoices may result in suspension or termination from the Academy
Payment methods
Payment will be made to the Business via cash, cheque, an approved payment card, or by any other payment method that is accepted by the Business.
Consumer Guarantees
(a) Nothing in this Agreement is intended to exclude, restrict or modify the rights which either of the parties may have under the Australian Consumer Law. (b) A failure to comply with the Consumer Guarantee provisions under the Australian Consumer Law to the extent they apply to this Agreement, the Business’ liability is limited to (at its election):
(i) in the case of a supply of goods: (A) replacing the goods or supplying equivalent goods; (B) repairing the goods; (C) paying the cost of replacing the goods or acquiring equivalent goods; or (D) paying the cost of having the goods repaired; and
(ii) in the case of a supply of services: (A) resupplying the services or (B) paying the cost of having the services supplied again.
Licensing
The Business promises that it holds all licenses necessary to perform the work, that such licenses are valid and effective as of the date any work is performed or services provided, and that all work performed or services provided will be done in compliance with all applicable federal and state , or local laws and regulations.
Cancellation of sessions
Scheduled sessions may be cancelled by JC Football party due to inclement weather, which is permissible on shorter notice though will be discussed between both parties as soon as inclement weather arises. Rescheduling of cancellations will be made following the completion of the 10 week program with a date advised by JC Football party. JC Football reserves all rights to reschedule and/or change venues for any reason. This will not be considered a cancellation.
Refunds
JC Football commits to doing everything possible to deliver all program hours and deliverables for every individual program. But will not be held liable to refunds or credits should it not be possible to deliver any component of the program for reasons out of our control.
Any refunds relating to our product line will be outlined in our “Returns and Refund Policy”
Modifications
The Client and the Business must agree to any changes to this contract in writing.
Consent
By enrolling in the JC Football program, participant understands that he/she attending the programs and using the facilities does so at his/her own risk. In addition, its owners, employees or agents, shall not be liable for any damage whatsoever arising from any personal injury or property loss sustained by participant with his/her family in or about any programs on the premises. Participants and parents assume full responsibility for all injuries and damages which occur in or about any programs on the premises. He/she does hereby fully and forever release discharged hold harmless, all associated facilities and its owner, employees, and agents from all claims, demands, damages or rights of action, present or future resulting from any person’s participation in any programs or use of the facility.
Consent: Guardian/participant or I the undersigned parent does hereby grant authority to the staff at to render a judgement concerning medical assistance or hospital care in the event of an accident or illness during my absence. I do hereby authorize and its assigns to utilize all photographs, pictures or other likeness of anyone or me assigned guardianship to me, as they deem appropriate in its promotional materials or team films.
